Assignments of Rights Agreements
The Independent Filmmaker/Producer/Investor desires to use the Author’s Work (story, script, book rights etc.) in her/his Project. The Producer (Recipient of Rights/Assignee) will use this Agreement to transfer the Rights in the Work to her/him from the Author (Owner of the Rights/Assignor). This is called “assigning” your right to receive the property or money.
Rights to a Work can be assigned just as any other contractual right. With an assignment, the Owner of the Rights (the “Author of the Work”) transfers the complete remainder of the Interest in the Work to the Recipient of the Rights, (the “Independent Filmmaker/Producer/Investor). The Rights assigned must not retain any sort of reversionary interest in the right to possess, unless specifically stated in the Agreement.
If the Producer is signing an Agreement for Rights to a Work she/he must check that no previously existing contract disallows allows an assignment. The Producer should also check whether the assignment substantially changes the obligations of the person with whom you signed the Agreement. If it does, your rights may not be assignable. The Producer is advised to have her/his Lawyer review the Agreement before signing.
This Agreement between the independent Author/Rights Owner and the Producer is drafted in plain English that is easy to read and comprehend. This is a “Short Form” Legal Agreement of three clauses and two pages. The Agreement may be filled in on your computer or printed out and filled in later.
This Agreement is part of the Actor’s Deal, Director’s Deal, Producer’s Deal, and the Investor’s Deal.
