The Independent Music Composer/Artist wants her/his music distributed. This contract is for TV distribution. If your Project is at the stage of distribution the Filmmaker should make certain that her/his Lawyer and accountant read the Agreement.
Television cable stations and networks can attract high viewer ratings by broadcasting independent Projects. The broadcasting networks’ appetite for independent Projects depends on several factors. The networks consider the comparative cost of buying made-for-television Projects and the kinds of ratings they can be expected to generate.
This Agreement is drafted in plain English that is easy to read and comprehend. This is a “Short Form” two page, seven clause legal Agreement. The Agreement may be filled in on your computer or printed out and filled in later.
We regularly receive feedback that we have successfully drafted our filmmaker contracts to be as complete as possible for all legal situations. Herein this Agreement the independent Filmmaker is called the “Producer”.
1. In consideration of the payment of __________________, and upon the payment of it to the above named and undersigned Owner/Composer, the undersigned Owner/Composer does hereby grant to Licensee, (hereafter the “Producer”), the non-exclusive, irrevocable right and license to record the following copyrighted musical composition(s) (the “Compositions”) in synchronization or timed-relation with a Project produced by the above named and below signed Producer (the “Project”) for television broadcast and exhibition only, as named above.
2. This is a License to record only, and the exercise of the Recording Rights herein granted is conditioned upon performance of the Composition(s) over television stations having valid Licenses from the copyright owner (“the Owner/Composer”), or from the person, firm, corporation or other entity having the legal Right to issue Performance Rights’ Licenses for the Owner/Composer in the respective Territory/Territories in which the Composition(s) shall be performed. The Composition(s) shall not be used in any manner and media or be recorded for any other purpose, except those specifically set forth herein, without the express written consent of the Owner/Composer. No sound recordings produced pursuant to this License are to be manufactured, sold and/or used separately from the Project; and the Project shall not be exhibited in or televised into theaters or other public places of amusement where motion Projects are customarily exhibited.
